1. Purpose of this manual

This manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (“PAIA”), and includes the additional information required of a responsible party under section 51 of the Protection of Personal Information Act 4 of 2013 (“POPIA”). It explains what records SA WebMall holds, and how a member of the public can request access to those records, or to the personal information SA WebMall holds about them.

A guide on how to use PAIA, compiled by the Information Regulator, is available from the Information Regulator at inforegulator.org.za, and describes the objectives of PAIA, the postal and street address, phone and fax number, and email address of the Information Regulator, and any assistance available from the Information Regulator.

2. About the body to which this manual applies

This manual applies to SA WebMall (Pty)Ltd (registration number 2026 / 167486 / 07), a private body as defined in PAIA, operating the SA WebMall online marketplace at sawebmall.co.za, with its registered address at 60 Baviaanspoort Road, East Lynne, Pretoria, 0183

4. Records held by SA WebMall

In the ordinary course of operating a multi-vendor marketplace, SA WebMall holds records in the following broad categories:

  • Customer records — account details, order history, delivery addresses, and support correspondence;
  • Vendor records — store registration details, banking details for payouts, product listings, and vendor agreements;
  • Financial and transaction records — payment processing records (via our payment gateway providers), invoices, refunds, and commission records;
  • Website and technical records — server logs, cookies and analytics data (see our Cookie Policy), and security/firewall logs;
  • Employee and contractor records — where SA Web Mall employs staff or engages contractors, standard HR and payroll records;
  • Marketing records — newsletter subscriptions and marketing consent records, where applicable.

6. How to request access to a record

Any person wishing to request access to a record held by SA Web Mall — including a request by a data subject for access to their own personal information under POPIA — should complete the prescribed request form (PAIA Form 2, available from the Information Regulator’s website) and submit it to the Information Officer using the contact details in clause 3.

Your request should provide sufficient detail to enable us to identify the record and yourself as the requester, an indication of which form of access is required, and the postal address, fax number or email address of the requester in the Republic.

7. Fees

A request fee and, where applicable, an access fee may be payable in accordance with the fees prescribed under PAIA. We will notify you of any applicable fee before processing your request. No fee is charged for a request by a data subject for their own personal information, except where reasonable.

8. Response time

We will respond to a properly completed request within 30 days, as required by PAIA, unless an extension applies (of which you will be notified in writing), or a shorter period applies under POPIA for a data subject access request.

9. Grounds on which requests may be refused

PAIA permits certain requests to be refused — for example, where disclosure would unreasonably disclose another person’s personal information, would be protected by legal privilege, or would prejudice a party’s commercial interests. Where a request is refused, in whole or in part, we will provide written reasons, and inform you of your right to lodge a complaint with the Information Regulator, or to appeal to a court.
